1. Introduction
1.1 Purpose of These Terms
These Terms and Conditions (“Terms”) govern your use of the “Mira KI Bild & Text Generator”
mobile application (“App”, bundle ID com.picasy.app), available on the Apple App
Store and Google Play Store. By accessing or using the App, you agree to these Terms. If you do
not agree, you must not use the App.
1.2 Additional Policies
In addition to these Terms, please review our Privacy Policy to understand how we handle your personal data.
1.3 Age Restrictions
- The App is primarily intended for users aged 12 and older. Use by persons under 12 is not permitted.
- If you are under 16 and certain features rely on consent (e.g., personalized ads), you must have parental or guardian consent.
2. Scope of the Services
2.1 AI-based Features
The App provides AI-driven generation of images, text/chat, and image-to-video, using third-party providers including OpenAI, ModelsLab, Runway and Kling. Results may be approximate, incomplete, or contain unexpected content.
2.2 User Accounts
Most features require a user account created with email/password or a third-party login (Google, Apple). You are responsible for keeping your credentials safe and for activity under your account. Notify us immediately if you suspect unauthorized use.
2.3 Free and Paid Features
The App operates on a virtual currency model. Many features are free or can be used by spending points; certain features require credits (e.g., video credits for image-to-video). You can obtain points/credits by purchasing point packs or credit packs, by subscribing to a premium plan, or — optionally — by watching reward-based ads. Payment is processed by Apple or Google under their terms.
2.4 Service Availability
We strive to keep the App available but do not guarantee uninterrupted operation. Service may be suspended for maintenance or updates without liability.
3. Points, Credits and Reward Ads
3.1 Nature of Virtual Items
Points and credits are a limited, revocable license to use functions of the App. They have no monetary value, cannot be exchanged for cash, and are not transferable between accounts. They are consumed when you generate content and may be subject to limits.
3.2 Reward Ads
You may optionally watch reward-based advertisements to earn points. Watching ads is voluntary; the reward is granted whether or not you have consented to personalized advertising.
3.3 Adjustments and Fraud
Purchases and point balances are verified server-side. We may withhold, reverse, or adjust points/credits obtained through error, abuse, chargebacks, or fraudulent activity, and may adjust the cost of features over time.
4. User Obligations and Acceptable Use
4.1 Lawful Use
You agree to use the App only in compliance with applicable laws, regulations, and these Terms.
4.2 Prohibited Content and Conduct
You must not create, upload, publish, or share content that:
- is unlawful, infringing, or violates third-party rights (copyright, trademark, personality rights);
- sexualizes minors or depicts non-consensual sexual content;
- impersonates or depicts a real, identifiable person without their consent (including deepfakes);
- is hateful, harassing, defamatory, or incites violence or extremism;
- contains malware, spam, or attempts to circumvent security, rate limits, or moderation.
We operate server-side content moderation and may remove or disable content, and suspend or terminate accounts, where there is evidence of a violation.
4.3 Responsibility for Your Content
You are solely responsible for the prompts and content you submit and warrant that you hold the necessary rights. Do not submit personal data of others without their consent, and do not upload photos showing other identifiable people (including their face) without their consent — note that such images may be processed by providers outside the EU, including in China.
4.4 Third-Party Platforms
When you access the App via the Apple App Store or Google Play Store, you must also comply with their terms.
5. Community and Live Feed
The App includes an optional public live feed. If you publish a generated image to the feed, it becomes visible to other users, who may like or report it. By publishing, you grant us and other users the right to view the image within the App. We may remove feed content that violates these Terms or the law, and feed images that are not liked are automatically deleted after 12 hours. You can remove your own images at any time.
6. Intellectual Property and Content Rights
6.1 Our Property
All intellectual property in or related to the App (trademarks, logos, code, text, designs) belongs to us or our licensors. Using the App grants you no ownership of the App itself.
6.2 Your Generated Content
Subject to your compliance with these Terms and the terms of the underlying AI providers, you may use the images and text you generate for personal and commercial purposes. Note that AI-generated output may not be eligible for copyright protection in every jurisdiction and that similar outputs may be generated for other users.
6.3 License to Us
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content as necessary to operate and improve the App (including showing images you publish in the live feed) and to route prompts to third-party AI providers to fulfill your requests.
6.4 Feedback
If you submit suggestions or ideas about the App, we may use them without obligation.
7. AI Disclaimer
7.1 Nature of AI Content
AI-generated text, images and videos may be inaccurate, incomplete, or contain unintended outputs. Use such content at your own risk.
7.2 No Professional Advice
AI output is not professional advice. Always consult qualified professionals for important decisions.
7.3 Third-Party AI Providers
We rely on services such as OpenAI, ModelsLab, Runway and Kling. We are not liable for their performance, data handling, or claims arising from their outputs. Note that the Kling video provider processes data in China; see our Privacy Policy.
8. Payment, Subscriptions and Withdrawal
8.1 In-App Purchases
All purchases (point packs, credit packs, subscriptions) are processed and billed by the respective app store. Review their policies for billing, cancellation and chargebacks.
8.2 Subscription Renewals
Premium subscriptions renew automatically for the chosen period unless cancelled at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple App Store or Google Play account settings.
8.3 Right of Withdrawal (EU/EEA consumers)
Points, credits and other digital content are supplied immediately. By purchasing and starting to use them before the end of the 14-day withdrawal period, you expressly consent to immediate performance and acknowledge that you thereby lose your right of withdrawal for the content already delivered/consumed (§ 356(5) BGB; Art. 16(m) Consumer Rights Directive).
8.4 Refunds
Refunds are generally governed by Apple’s or Google’s policies; we do not process payments directly and therefore cannot issue refunds directly, except where required by mandatory law.
9. Termination and Suspension
9.1 By You
You may stop using the App at any time and delete your account in the App (Settings). Account deletion has a 7-day safety window during which it can be revoked; afterwards your data is permanently removed as described in the Privacy Policy.
9.2 By Us
We may suspend or terminate your access for good cause (e.g., breach of these Terms or the law). Where lawful, unused points/credits may be forfeited upon termination for breach.
9.3 Post-Termination
Upon termination, your license to use the App ends. Provisions on intellectual property, disclaimers, liability limitations, and indemnification survive.
10. Disclaimers and Liability
10.1 Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, to the extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 Limitation of Liability
To the extent permitted by law:
- We are not liable for indirect or consequential damages.
- Our aggregate liability is limited to the amount you paid in the three months preceding the event, or EUR 100, whichever is higher.
- Mandatory liability (e.g., for intent, gross negligence, injury to life or health, or under product liability law) remains unaffected.
10.3 User Content and Third-Party Services
We bear no responsibility for user-generated content or for third-party services (including AI outputs) integrated with the App.
10.4 Local Consumer Rights
These Terms do not override mandatory consumer protections under applicable law.
11. Indemnification
You agree to indemnify and hold us harmless from losses or damages (including reasonable legal fees) arising from your breach of these Terms, your unlawful content, or your misuse of the App.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany, without prejudice to mandatory consumer protection rules of your country of residence. Disputes are subject to the courts at our place of business, unless mandatory local law provides otherwise.
13. Changes to These Terms
We may modify these Terms for legal or operational reasons. We will notify you of material updates (e.g., in the App). Continued use after the effective date constitutes acceptance of the new Terms.
14. Miscellaneous
Failure to exercise a right is not a waiver. If any provision is invalid, the remainder stays in effect. These Terms and the referenced Privacy Policy form the entire agreement regarding the App. We may assign our rights and obligations in a reorganization, merger, or sale of assets.
